Kim Davis, loser
Appeals Court dismisses her suit against former governor

by Mike Andrew - SGN Staff Writer

Kim Davis, the Kentucky clerk who defied the U.S. Supreme Court by refusing to issue marriage licenses to same-sex couples, has lost a suit alleging that her religious liberty was denied by the state.

The Sixth Circuit Court of Appeals dismissed Davis's suit on April 19, saying she had not shown any irreparable harm.

Davis grabbed headlines by turning away same-sex couples who came to her office for marriage licenses in the wake of the Supreme Court's Obergefell decision. After being ordered by a federal district court not to discriminate against same-sex couples, she stopped issuing the licenses altogether.

The ACLU then sued her on behalf of two same-sex and two opposite-sex couples Davis had turned away. Davis retaliated by suing Kentucky's then-Gov. Steve Beshear and then-State Librarian Wayne Onkst, claiming they were violating her religious beliefs by requiring her name to appear on documents authorizing same-sex marriage.

Beshear left office in December, and his successor, current Kentucky Gov. Matt Bevin, issued an executive order removing the names of county clerks from marriage licenses.

That fact was sufficient, the Sixth Circuit said, to establish that Davis was not suffering harm from same-sex marriages.

'The revision of the official marriage license form eliminates any claim by Davis that she is suffering any serious or irreparable consequences as the result of the district court's order,' the appeals court said.

The ACLU suit against Davis is still pending.
