Southern Poverty Law Center sues feds over DOMA

The Southern Poverty Law Center announced on February 2 that it will sue the U.S. government on behalf of a disabled Lesbian veteran and her wife.

Tracey Cooper-Harris served in the U.S. Army for 12 years, earning more than two-dozen medals and commendations. She was honorably discharged in 2003.

She married her wife in California during the brief period in 2008 when same-sex marriage was legal in that state. She met her wife, a former teacher, when the two played on opposing rugby teams in California. They now live in Pasadena.

Their marriage continues to be legal, even though California voters subsequently passed Prop 8, which reversed marriage equality.

In 2010, Cooper-Harris was diagnosed with multiple sclerosis, a disabling disease that attacks the brain and central nervous system, and she has received disability benefits through the U.S. Department of Veterans Affairs as a result.

The Department of Veterans Affairs denied Cooper-Harris' application for additional benefits for her partner, even though their same-sex marriage is legal in California.

'We're only asking for the same benefits as other married couples. We simply want the same peace of mind that these benefits bring to the families of other disabled veterans,' said Cooper-Harris at a press conference in Washington on Wednesday.

The Defense Department has said that the federal Defense of Marriage Act (DOMA) prohibits the military from extending benefits to the partners of gay service members, even if they are legally married.

In their suit on behalf of Cooper-Harris, the Southern Poverty Law Center charges that the Department of Veterans Affairs discriminated against the couple by denying them benefits that are regularly offered to spouses in heterosexual marriages.

It also charges that DOMA is unconstitutional because it bans federal agencies from recognizing same-sex marriages, denying same-sex couples benefits available to couples in opposite-sex marriages.
