Parents seek justice in attack on Transgender daughter

Tad and Cindy Anderson, the parents of a Ballard girl, are seeking justice after their daughter - whom they believe was beaten because she is Transgendered - was brutally attacked with a baseball bat August 16.

Tiva, whose age has not been released, was assaulted by another girl in Ballard at the intersection of 28th Ave. N.W. and N.W. 67th St., according to a police report.

The assault resulted in a serious head injury and, according to her parents, Tiva is emotionally fragile since the attack.

She has learning disabilities that can make it hard to interact with her, and she is Transgender, Tivas parents wrote in an email to neighbors, as originally reported by the My Ballard website.

It probably should have been obvious to us a long time ago, but this turns out to be a dangerous combination. Transgender people are the most likely to be harassed, and Tiva is particularly vulnerable due to her limited social skills, the email said.

While the attack happened on August 16, Tiva did not go to the hospital until a few days later, according to the police report.

THE ATTACK

Tiva was questioned, post surgery, about the attack on August 20 by SPD officer John Schweiger, who said the victim was drifting in and out of sleep during the interview.

According to Schweigers report, Tiva was walking home when she was attacked and was dressed in female clothing at the time of the attack.

A female accompanied by a male began following Tiva, who told police the girl was carrying a baseball bat.

Tiva stated that when she crossed the street at 28th and 67th, the female came up alongside her and said, I dont want to see you around the skate bowl anymore.

The female then struck Tiva on the right side of the head with the baseball bat. Tiva continued to her residence, where after several days the severity of the injury became apparent.

IN SEARCH OF JUSTICE

As a result of the attack, Tiva had sustained a subdural hematoma. According to the on-duty nurse at the time of Tivas questioning, the symptoms of such an injury appear slowly and it can be fatal if not attended to. A portion of her skull was removed for treatment of the injury. Tiva is expected to make a full recovery.

Cindy and I are trying to assemble a team to help with her recovery, Tad Anderson told My Ballard. To keep her safe in the future, and, generally, to try to rebuild her self-confidence and trust in others.

Tiva is very reluctant to talk about the incident to us [her parents], Tad Anderson said. We have learned through others that the woman who attacked her was also harassing her for dressing in female clothing, saying, You should not be wearing those clothes (or words to that effect).

There is very little information about the crime, but what Tivas parents do know is that the attacker is a white female and they believe she may hang out around the skate bowl at Ballard Commons Park.

Seattle police spokesman Mark Jamieson said the case is not being investigated as a hate crime because Tiva did not tell police she was attacked for being Transgender. He said he did not know if police planned to interview Tiva again about the incident.

Although the case is currently listed as inactive with the SPD, spokesman Sean Whitcomb said the case was active and is under investigation. He said the case is being investigated as a violent crime and if it is determined there was bias involved in the crime, it is then up to the prosecutor to determine whether to add bias to any charges  which would elevate the charge under hate crimes laws.
