Recording blocked indefinitely at Prop 8 trial

Two hours before the Proposition 8 trial, Perry v. Schwarzenegger, was scheduled to start on January 11, the U.S. Supreme Court blocked video recording of the proceedings from being posted on internet video site YouTube.

The court stated that justices needed more time to review the issue, and therefore tabled the discussion until January 13.

Proposition 8 supporters have sought to block footage of the trial from being uploaded to YouTube after it had already been approved. Chief U.S. District Judge Vaughn R. Walker stated that the case was appropriate for wide dissemination because it dealt with an issue of wide interest and importance.

However, in a rare rebuke to a trial judge, the Supreme Court voted 5-4 to block the planned telecasting of the trial over the constitutionality of Proposition 8. The court ruled that Chief U.S. District Judge Walker had not given the public enough time to comment on the telecasting before issuing his order.

"The Supreme Court just struck a huge blow against transparency and accountability. The five conservative justices are enabling the Prop 8 supporters to mask their radical views, preventing the transparency that an effective court system needs. This historic trial will remain largely hidden from public view, despite its historic potential to challenge and change the minds of Americans," said Rick Jacobs, chair of the Los Angeles-based, 700,000-member Courage Campaign in a statement regarding the Supreme Court's decision.
